REVIEWS

  • A Notary Public is an official of integrity appointed by the state government — typically by the secretary of state — to serve the public as an impartial witness in performing a variety of official fraud-deterrent acts related to the signing of important documents. These official acts are called notarizations, or notarial acts.

Notaries are publicly commissioned as "ministerial" officials, meaning that they are expected to follow written rules without the exercise of significant personal discretion, as would otherwise be the case with a "judicial" official.

  • Item description
  • Notary Personal Knowledge: meaning the Notary knows the identity of a person through reasonable certainty that the person has the identity claimed (the longer known has been acquainted with a person and more interaction the more likely the Notary can claim personal knoweledge of the individuals identity).

Most Driver's licenses, non-driver’s ID cards, Passports, Consular Identification card

Oath or Affirmation of a Credible witness: When a document signer is not personally known to the Notary and is not able to present an acceptable ID card, the signer may be identified of a credible identifying witness. Qualifications: Nevada law requires that a credible identifying witness be present at the time of the notarization, be personally known to both the Notary and the Signer, and must swear or affirm to the Notary that the signer is the personal whom the signer claims to be.

Acceptable ID’s for 65 or Older?

If a person who is 65 years of age or older does not have an ID that meet the acceptable ID requirements and can not produce a credible identifying witness, tthan an ID card issued by a governmental agency or senior citizen center is acceptable. In this case a Notary is allowed in the state of Nevada to ask for a secondary form of identification, anything that will support the identify on the primary ID

  • Social Security Cards, Birth Certificates, and Credit Cards are worthless as a primary identifying documents.

A Notary may however serve as a secondary identification in situations in He or She wishes to reconfirm the identity on the primary ID card presented in the state of Nevada.

  • In the state of Nevada, Acknowledgments do not need to be signed in front of a Notary, the signer however must acknowledge that He or She made the signature.

The signer must appear in front of the Notary with the signed document at the time of the notarization.

**However, if the document is an acknowledgment but it also requires a Jurat the documents must not be signed before appearing to the Notary, as a Jurat requires the documents to be signed in the presence of the Notary.

  • To notarize a Jurat it requires the signer to personally appear before the Notary, be present to swear to or affirm, and sign documents in the presence of the Notary.

  • The Nevada Secretary of State permits Notaries to refuse to certify a copy of a document written in a language they cannot read. This may cause the Notary to certify a copy of a document that may not be legal to copy.

  • By Nevada Secretary of State stipulates that Notaries may not refuse to perform an Acknowledgment or Jurat on a document that they cannot read, as long as all other requirements for the notarial act are met.

  • It is against the law for Notaries to help choose what Notarization is needed for the signer requesting the Notarization.

Notaries may only provide a brief description of each different type of Notarial acts and that is all. If the signer still doesn’t know what Notarial act is needed they would need to get in contact with the issuing or receiving agency requesting the notarization and ask them what Notarial act and wording is needed for the document.

  • General Notary work tends to take no longer than 30 minutes.

Loan signing tends to take no longer than 45-60 minutes.

  • The signer's ID must adequately identify the signer as He or She is named in the document.

Ex. If one of the signer’s first or middle names is an initials in the document (John D. Smith) but is the full name on the document (John David Smith), then the ID adequately identifies the signer.

Ex. If on the other hand, one of the signer's first or middle names is an initial on ID card but NOT on the document, then the ID is not sufficient to identify the signer. In this case, the initial could stand for any number of names other than the one in the document.
